4. Booking Requests

Submitting a booking request through vilasilvia.com:

- does not constitute a confirmed reservation
- does not constitute payment
- does not charge the visitor
- does not collect credit-card or debit-card information
A booking request is simply a request for Villa Silvia to contact the visitor regarding a possible stay.
After receiving the request, Villa Silvia may communicate directly with the prospective guest regarding availability, price and the conditions applicable to the requested stay.
5. When a Reservation Becomes Confirmed
A booking request submitted through the website is not automatically a confirmed reservation.
Before a direct reservation becomes binding, Villa Silvia will communicate the material conditions applicable to the proposed stay.
These may include:
- dates of stay
- number of guests
- total price
- applicable mandatory charges
- payment arrangements
- payment deadlines
- cancellation conditions
- modification conditions
- arrival and departure information

A reservation becomes confirmed only after the confirmation procedure communicated by Villa Silvia has been completed and Villa Silvia has provided confirmation to the guest, normally by email or another agreed durable means of communication.

6. No Payments Through the Website
No payment is made or processed through vilasilvia.com.

7. Prices

The price applicable to a direct reservation is the price communicated to and accepted by the guest for the specific requested stay.
Before a reservation becomes binding, the guest will be informed of the total price and any unavoidable charges applicable to that reservation.
Depending on the particular booking, these may include applicable:

- deposits
- cleaning charges
- other mandatory fees
No additional mandatory charge should become payable solely because it was not disclosed before the booking was confirmed.
8. Payment Arrangements
Where payment is required for a confirmed reservation, it takes place outside vilasilvia.com.

10. No General 14-Day Right of Withdrawal for Date-Specific Accommodation
Consumers should note that the general 14-day withdrawal right applicable to many distance contracts does not apply to non-residential accommodation services where the service is to be provided on a specific date or during a specific period.
Croatian consumer law expressly excludes such date-specific accommodation contracts from the general right of withdrawal.
Therefore, a confirmed reservation cannot automatically be cancelled within 14 days simply because it was arranged remotely.
Any applicable cancellation or refund rights are determined by:
- the conditions of the individual reservation
- mandatory consumer law
- any additional rights expressly granted by Villa Silvia
11. Changes Requested by the Guest
Requests to change a confirmed reservation are subject to availability and acceptance by Villa Silvia.
This includes requests concerning:
- dates
- number of guests
- duration of stay
- other material booking conditions
A requested change may result in a different price, payment schedule or cancellation conditions.
Any material change will be communicated before becoming binding.
12. Changes or Cancellation by Villa Silvia
If Villa Silvia becomes unable to provide accommodation that has already been confirmed, the guest will be informed as soon as reasonably possible.
The consequences will be handled in accordance with:

- the circumstances concerned
- applicable Croatian and European Union law
Nothing in these Terms limits any mandatory right of a consumer to reimbursement, compensation or another remedy where such a right exists under applicable law.
13. Guest Eligibility
The person making a reservation must:
- be at least 18 years old
- have legal capacity to enter into the accommodation agreement
- provide accurate information
- provide valid contact details
The person making the reservation is responsible for ensuring that the members of their group are informed of and comply with the conditions applicable to the reservation and stay.
14. Guest Registration and Identification
Villa Silvia is required to comply with Croatian statutory guest-registration requirements.
Guests must therefore provide the information required for registration in the national eVisitor system.
Information may be taken from:
- an identity card
- passport
- another legally accepted identity document
Croatian rules require accommodation providers to register guests in eVisitor within 24 hours of arrival and deregister them within 24 hours of departure.
Guests are required to provide the information necessary for Villa Silvia to fulfil this legal obligation.
15. Check-in and Check-out
Guests must comply with the check-in and check-out times communicated in connection with their reservation.
Early check-in or late check-out may be possible only where expressly agreed with Villa Silvia.
They should not be assumed to be available unless confirmed.
16. Maximum Occupancy
The number of persons staying overnight at Villa Silvia may not exceed:
- the number confirmed in the reservation, or
- the legally permitted capacity of the accommodation,
whichever is lower.
Additional or unregistered overnight guests are not permitted unless expressly agreed with Villa Silvia and permitted under applicable law.
17. House Rules
Guests must comply with the House Rules applicable to Villa Silvia.
The House Rules may contain additional provisions relating to:
- arrival and departure
- quiet hours and noise
- visitors
- smoking
- pets
- swimming-pool use
- children and supervision
- parking
- waste disposal
- safety
- sports and recreational facilities
- bicycles
- use of outdoor areas
- furniture and equipment
- parties, events or gatherings
Where House Rules form part of the accommodation agreement, they will be made available to the guest in an appropriate manner.
18. Responsible Use of the Property
Guests are expected to use Villa Silvia and its facilities responsibly and with reasonable care.
The villa, gardens, swimming pool, terraces, recreational facilities, furniture and equipment should be used only for their intended purposes.
Guests must not intentionally or negligently damage the property or create unnecessary risk to people, property or neighbouring properties.
19. Damage to the Property
Subject to applicable law, a guest may be responsible for damage caused intentionally or negligently by:
- the guest
- members of their group
- persons for whom the guest is legally responsible
Normal wear and tear is not considered damage.
If a specific reservation involves a security deposit or another damage-related arrangement, this will be communicated before the reservation is confirmed.
20. Children and Supervision
Children must be appropriately supervised by a responsible adult.
Particular care should be taken around facilities and areas such as:
- swimming pool
- playground
- trampoline
- sports areas
- stairs
- terraces
- gardens
These provisions do not exclude or reduce any legal responsibility of Villa Silvia that cannot lawfully be excluded.
21. Swimming Pool and Recreational Facilities
Guests must use the swimming pool, bicycles, sports areas and other recreational facilities responsibly.
Any safety instructions provided at the property must be followed.
Guests are responsible for considering their own abilities and for appropriately supervising children and other persons requiring supervision.
22. Personal Belongings
Guests are expected to take reasonable care of their personal belongings.
Any liability of Villa Silvia for loss, theft or damage is determined by applicable law.
Nothing in these Terms excludes liability where exclusion would not be legally permitted.
23. Events Beyond Reasonable Control
There may be exceptional circumstances outside the reasonable control of either party that prevent or materially affect the provision of accommodation.
Such circumstances may include, where applicable:
- serious natural events
- governmental restrictions
- major infrastructure failures
- other extraordinary events outside reasonable control
The legal consequences of such circumstances will be determined according to applicable law and the conditions of the individual booking.
Mandatory consumer rights remain unaffected.
24. Liability
Villa Silvia is responsible for its obligations to the extent required by applicable Croatian and European Union law.
Nothing in these Terms is intended to exclude or restrict:
- liability that cannot legally be excluded
- mandatory consumer rights
- statutory rights to compensation or other remedies
Guests remain responsible for their own unlawful or negligent behaviour and for responsible use of the accommodation and its facilities.
25. Third-Party Booking Platforms
Villa Silvia may also be presented or bookable through independent booking platforms.
Where a reservation is made through a third-party platform, that platform's own conditions may apply to matters including:
- reservation process
- payment
- cancellation
- refunds
- service fees
- communication
A payment processed by an independent booking platform or its payment provider is not a payment processed through vilasilvia.com.
Visitors should review the applicable terms of the relevant platform.
26. External Websites and Services
The website may contain links to independent third-party websites and services, including:

Villa Silvia does not control the independent operation or content of those third-party services.

Under the Croatian Consumer Protection Act, a trader must currently respond to a written consumer complaint within 15 days of receiving it and retain records of written complaints on a durable medium for one year.
31. Alternative Dispute Resolution
Villa Silvia encourages guests to contact us directly first where a question, disagreement or complaint arises so that the matter can, where possible, be resolved directly.
Consumers may also use competent alternative dispute-resolution mechanisms available under Croatian and European Union consumer law where applicable.
32. Applicable Law
These Terms and direct accommodation agreements with Villa Silvia are governed by Croatian law.
Where the guest is a consumer, this choice of law does not deprive the guest of mandatory consumer protections that apply under relevant European Union law.
33. Jurisdiction
Jurisdiction over disputes is determined in accordance with applicable Croatian and European Union law.
Nothing in these Terms restricts a consumer's mandatory right to bring proceedings before a court available to them under applicable consumer and jurisdiction rules.
34. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions remain effective to the extent permitted by law.
The affected provision will apply only to the maximum extent legally permissible.
35. Changes to these Terms
Villa Silvia may update these Terms to reflect changes to:
